Governors of 35 states filed suit against Fed Government.. Print E-mail
Articles - Government
Written by Bob Davis, Chairman

To my friends, customers and family.

I forward this with serious questions about its method (Constitutional Convention).  However, it is important for all citizens to discuss and understand all points of view so here is mine along with my contact information if you would like to discuss a varying opinion.

Nothing is more dangerous to our freedom than a Constitutional Convention. The laws and Constitution we now have are being ignored by our legislators. Adding new laws or changing the Constitution would simply give them another set of laws to ignore.  They have taken control of one of the largest car makers in the world without paying one cent to the share holders.  Forget the fact that it is theft, forget that it is morally contemptuous, it is entirely ILLEGAL.  There is NO Constitutional authority for this action. There is no constitutional authority for them to bail out the largest banks in the world either(see the 10th Amendment).  We need to hold them to the existing U.S. Constitution.  The founding fathers created the Constitution so we could manage the monster that the Federal government could, and now, has become.  They set the term of a Congressman at only 2 years.  The House of Representatives controls all spending and that is why the term is so short.  We all must get involved in our government and start throwing the bums out of office when they misbehave.

The news media controls the election process by what they do not tell you. They don't tell you how your legislators vote in each session.  If they did you would be able to easily see when they misbehave and throw them out next election.  They don't tell you because they want to be able to control who is elected through spin.  If you think the Republican party is the solution to our problems, I would remind you that there is a Democratic controlled Congress and a Democratic President because they were screwing it up so bad. Remember who first signed over Billions to the large banks.  Yes, that's right, George Bush.  They create departments like "Home Land Security" and at the same time completely ignore the fact that droves of illegal aliens (including middle eastern aliens) rush across our southern border in broad daylight.  Security????  Who do they think they are kidding?  Having been involved with the Indiana Republican party at the last presidential election as a delegate, I can tell you that the structure and by-laws of the Indiana Republican party are setup to prevent a grass roots takeover.  They ignored their own rules to prevent Ron Paul delegates from working in the political process.  I am not saying that the party cannot be changed, I am saying it will take at least 6 years to clean out the existing insiders and the country will not be able to wait that long.  I will be voting Libertarian in the next election.  I would like to say that I am not against the 28th Amendment to the Constitution as suggested below.  I am against doing it through a Constitutional Convention where the entire Constitution could be scrapped (Our Constitution came to be from a Constitutional Convention where the previous Constitution was scrapped).  We have made 27 amendments to the Constitution without a Constitutional Convention and this one should be no different.

I would end my comments with two quotes showing how the founders understood what we face today.  Ask yourself if you think we have such men today to formulate a new Constitution at a Constitutional Convention;

"This picture is not too highly wrought; though, I confess, it would not long remain a just one, safety from external danger is the most powerful director of national conduct. Even the ardent love of liberty will, after a time, give way to its dictates. The violent destruction of life and property incident to war, the continual effort and alarm attendant on a state of continual danger, will compel nations the most attached to liberty to resort for repose and security to institutions which have a tendency to destroy their civil and political rights. To be more safe, they at length become willing to run the risk of being less free."

-- Federalist Papers Alexander Hamilton, Number 8, p.114 - p.115

The "war or terror" has been used to steal more freedoms than any previous conflict.

"Although all men are born free, slavery has been the general lot of the human race. Ignorant - they have been cheated; asleep - they have been surprised; divided - the yoke has been forced upon them. But what is the lesson? ...the people ought to be enlightened, to be awakened, to be united, that after establishing a government they should watch over it.... It is universally admitted that a well-instructed people alone can be permanently free."

--James Madison

We need to get informed and get involved.  We dare not leave it up to the parties.  Don't let them control who comes to the debates!  If they try it, don't vote for them.  We need verifiable paper ballots!!!

Subject: Governors of 35 states filed suit against Fed Government...

Governors of 35 states have already filed suit against the Federal
Government for imposing unlawful burdens upon them. It only takes 38 (of
The 50) States to convene a Constitutional Convention.

This will take less than thirty seconds to read. If you agree, please
Pass it on.

An idea whose time has come

For too long we have been too complacent about the workings of Congress.
Many citizens had no idea that members of Congress could retire with the
Same pay after only one term, that they didn't pay into Social Security,
That they specifically exempted themselves from many of the laws they have
Passed (such as being exempt from any fear of prosecution for sexual
Harassment) while ordinary citizens must live under those laws. The latest
Is to exempt themselves from the Healthcare Reform that is being
Considered...in all of its forms. Somehow, that doesn't seem logical. We do
Not have an elite that is above the law. I truly don't care if they are
Democrat, Republican, Independent or whatever. The self-serving must stop.
This is a good way to do that. It is an idea whose time has come

Have each person contact a minimum of twenty people on their Address list;
In turn ask each of those to do likewise.

In three days, most people in The United States of America will have the
Message. This is one proposal that really should be passed around.

Proposed 28th Amendment to the United States Constitution "Congress
shall make no law that applies to the citizens of the United
States that does not apply equally to the Senators and/or Representatives;
And, Congress shall make no law that applies to the Senators and/or
Representatives that does not apply equally to the citizens of the United
States ."

You are one of my 20.

Written by Jerry Titus

In the continuing spirit of providing Constitutional solutions and alternatives, of which we are not alone, ICRC Chair Bob Davis has reworked the Montana Firearms Freedom Act for Indiana.

Montana and Tennessee both have both passed their versions it into legislation. South Carolina and Florida have recently introduced versions for legislature consideration as well.

New gun law aimed at asserting sovereignty

By KAHRIN DEINES - Associated Press - 04/16/09

"Gov. Brian Schweitzer has signed into law a bill that aims to exempt Montana-made guns from federal regulation, adding firepower to a battery of legislative efforts to assert states' rights across the nation.

"It's a gun bill, but it's another way of demonstrating the sovereignty of the state of Montana," Democrat Schweitzer said.  ..."

Montana Governor Signs Revolutionary New Gun Law

"Sent to us by Ernest Hancock Freedom's Phoenix May 4, 2009The State of Montana has defied the federal government and their gun laws. This will prompt a showdown between the federal government and the State of Montana. The federal government fears citizens owning guns. They try to curtail what types of guns they can own. The gun control laws all have one common goal - confiscation of privately owned firearms.

Montana has gone beyond drawing a line in the sand. They have challenged the Federal Government. The fed now either takes them on and risks them saying the federal agents have no right to violate their state gun laws and arrest the federal agents that try to enforce the federal firearms acts. This will be a world-class event to watch. Montana could go to voting for secession from the union, which is really throwing the gauntlet in Obamas face. If the federal government does nothing they lose face. Gotta love it. ..."

FL. Rep. Marlene O'Toole Introduces Florida Firearm Freedom Bill

Marlene O'Toole

Marlene O'Toole

"If you have been living under a rock lately you may have missed the push by states to get 10th amendment resolutions passed. These are to remind the Federal Government of States Rights and State Sovereignty.

Most recently Montana passed a fantastic piece of legislation called the Montana Firearms Freedom Bill. What does this bill do? Simple, It tells the Federal Government that any firearms or ammunition created, built or sold in the state of Montana are not subject to Federal Legislation.

Representative O'Toole has introduced such legislation in the Florida House. Her bill HB-21 is almost the same as the Montana Bill. When I called her office for comment she was out of town. But I will be following up with her about the bill. I hope everyone interested in the bill in the State of Florida will call all of his or her Representatives in the State House to support this bill. ..."

Tennessee Firearms Freedom Act To Pass Without Signature
By Kleinheider Posted on June 12, 2009 at 5:52 pm

"Governor Phil Bredesen will not stand in the way of House Bill 1796. He will allow it to pass without his signature.

Bredesen, in a letter to Speaker Kent Williams, states that the bill which says that federal laws do not apply to firearms, accessories, or ammunition that is manufactured in Tennessee, will likely be found to be unconstitutional.

"This bill is not about firearms. It is about a fringe constitutional theory that I believe will be quickly dispensed with by the federal courts.

The Tennessee General Assembly lacks the Constitutional authority to limit the power and authority of federal government in this way...

...While I share the General Assembly's commitment to federalism, this legislation contravenes our Constitution. I am allowing it to become law so that it can quickly be dealt with by the federal courts."

Excuse me? What exactly is our governor saying here? I believe in federalism - except when the states really try to take real power back? I believe in federalism - but not for things like this?

What is unconstitutional about this? If a gun is made here and kept here what the heck business of the federal government is it? If Tennessee wants to make its own laws on firearms why is that bad and how is it unconstitutional?  ..."

The drafters of the law intend setting off a legal challenge with the Bureau of Alcohol, Tobacco, Firearms and Explosives.[4] Texas and Alaska have introduced similar copies of the law, with Minnesota, South Carolina, and Tennessee following the month afterwards. [4]
